PEAKCREWS™ ACCEPTABLE USE POLICY
Version 1.3 | Effective Date: July 15, 2025
This Acceptable Use Policy ("Policy") is incorporated by reference into PeakCrews' Terms of Service and governs all use of the PeakCrews website and mobile application (collectively, the "Platform") as well as user conduct at any job site arranged through the Platform. Violation of this Policy constitutes a material breach of the Terms of Service and may result in suspension or termination of access, forfeiture of fees, and potential civil or criminal liability.
1. Scope
This Policy applies to all Users of the Platform, including:
- Professionals: Independent contractors and skilled-trade workers offering services.
- Hirers: Businesses or individuals posting jobs and requesting services.
- Visitors: Anyone browsing the public pages of the Platform.
2. Prohibited Digital Activities
Users must not use the Platform to engage in any of the following:
2.1 Illegal or Fraudulent Conduct
- Misrepresenting identity, qualifications, licenses, certifications, or affiliations.
- Posting false or misleading job descriptions (scope, pay, site conditions).
- Engaging in money laundering, terrorist financing, or other illicit financial activities.
2.2 Intellectual Property Infringement
- Uploading or sharing content that violates copyrights, trademarks, patents, trade secrets, or other proprietary rights.
2.3 Harassment, Hate Speech & Defamation
- Harassing, threatening, or promoting violence against individuals or groups.
- Discriminatory or hateful content based on protected characteristics.
- Publishing defamatory or knowingly false statements about any person or entity.
2.4 Spam & Security Violations
- Sending bulk, deceptive, or unsolicited messages via the Platform.
- Harvesting, scraping, or mining user data without consent.
- Attempting unauthorized access (hacking), distributing malware, or launching denial-of-service attacks.
- Probing, scanning, or testing Platform vulnerabilities without express written authorization.
3. Prohibited On‑Site & Job‑Related Conduct
When performing work arranged through the Platform, Users must comply with all applicable laws, professional standards, and this Policy. Prohibited conduct includes:
3.1 Unsafe Practices
- Ignoring safety protocols or creating unsafe work conditions, including violations of OSHA or similar regulations.
- Working under the influence of alcohol, illegal drugs, or any impairing substance.
- Reckless or unauthorized use of tools, machinery, or equipment.
3.2 Misconduct & Unprofessionalism
- Theft of tools, materials, or personal property.
- Willful damage to property.
- Failing to appear for a scheduled Job without providing reasonable notice under the Terms of Service.
- Performing work without required licenses, permits, or certifications.
3.3 Fee Circumvention
- Soliciting or facilitating transactions, communications, or payments outside the Platform to avoid Service Fees.
- Submitting or accepting payments by unapproved methods.
4. Enforcement & Remedies
PeakCrews reserves the right to investigate and take appropriate action against any User suspected of violating this Policy. Actions may include:
- Issuing warnings or temporary restrictions.
- Immediate suspension or permanent termination of account access.
- Removal or disabling of violating content.
- Withholding or forfeiture of payments related to the violation, to the fullest extent permitted by law.
- Reporting conduct to law enforcement or regulatory authorities.
- Pursuing any other legal or equitable remedies available.
5. Reporting Violations
To report suspected violations, contact our Trust & Safety team:

- Subject: Acceptable Use Policy Violation
- Details: Include your name, account information, relevant Job ID(s), and a description of the violation with any supporting evidence.
6. Changes to this Policy
We may update this Policy to reflect changes in law or our services. For material changes, we will provide at least fourteen (14) days’ notice via email or in-app notification. Continued use after the effective date constitutes acceptance of the updated Policy.
7. Governing Law
This Policy and any disputes arising under it will be governed by the laws of the State of Colorado, without regard to conflict-of-law principles.
8. General Provisions
- 8.1 Severability. If any provision is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
- 8.2 Waiver. Failure to enforce any right under this Policy does not constitute a waiver of that right.
- 8.3 Interpretation. Headings are for reference only and do not affect interpretation.
- 8.4 No Third‑Party Beneficiaries. This Policy does not create rights enforceable by third parties.
